Northvolt, Intrum, and SAS are turning to Chapter 11 of the U.S. bankruptcy process to resolve financial distress while keeping operations running. But is it the right fit for all firms?

Swedish House of Finance and Stockholm Center for Commercial Law held a discussion on shaping the future of insolvency regulation and the role of European and American processes. The discussion examined key aspects of corporate restructuring, including:

  • What are the advantages and disadvantages of Chapter 11 compared to Sweden’s corporate restructuring procedure?
  • Who benefits the most from Chapter 11, and is it suitable for all size companies?
  • What could the next European reform package and European policymakers learn from non-U.S. Chapter 11 cases?

Speakers

Edith Hotchkiss, Professor, Boston College Carroll School of Management (via Zoom)
Anko van der Werff, President & CEO, SAS – Scandinavian Airlines

The discussion was moderated by Bo Becker, Director & Professor, Swedish House of Finance at the Stockholm School of Economics.
